- On March 25, 2026, California Assemblymember Jesse Gabriel introduced Assembly Bill (AB) 2244, which would create a “non-ultra-processed food” certification seal in the state. The bill follows the recently passed Real Foods, Healthy Kids Act, which establishes a definition for ultra-processed foods in California, as we have blogged.
- Under AB 2244, the “California Certified” seal could be placed on food products that meet clear standards for not being “ultra-processed.” The Real Foods, Healthy Kids Act defines the category to include foods containing one or more of certain types of ingredients, such as colorants, flavorings, sweeteners, emulsifiers, and thickening agents.
- The seal would be modeled after the “USDA Organic” seal and is “intended to provide consumers with a way to quickly identify ‘healthier’ food options.” The bill would also require grocery stores to feature products bearing the seal in “prominent, high-traffic areas for greater visibility.”
- Keller and Heckman will continue to monitor this and other food related legislation.
